Paxil Lawsuit: Paxil birth defects unfortunately happen more often than wanted. Studies have suggested that women who take Paxil during pregnancy significantly increase the risk of giving birth to a baby born with a Paxil birth defect. These defects include heart malformations such as atrial and ventricular septal defects and in some cases persistent pulmonary hypertension. As a result of babies being born with these heart defects, there are couples who have filed a Paxil birth defect lawsuit. In Philadelphia, the parents of a child born with severe heart defects are suing GlaxoSmithKline. The parents claim that the mother’s use of Paxil while pregnant caused their child to have injuries. The parents believe that their son, now two years old, was born with severe side effects from Paxil, that included heart defects, as a result of being exposed to Paxil while in the womb. The complaint asserts that GlaxoSmithKline knew or should have known about the negative Paxil side effects concerning the increased risk of congenital heart defects. According to the plaintiffs, the child has undergone three open heart surgeries and now has to have a pacemaker. The parents state that as the child continues to grow, more heart surgeries will be needed to replace a conduit and to insert artificial replacement valves in the heart. The pacemaker will also need to be maintained, and he is at risk for having a heart transplant later in life. The plaintiffs will seek compensation for negligence and negligence per se, negligent pharmaco-vigilance, failure to warn and break of express and implied warranty.

The Paxil attorney representing GlaxoSmithKline states the manufacturer conducted an analysis and found babies were at a significantly increased risk for congenital malformations when their mothers took Paxil compared to other antidepressants and then sent a “Dear Doctor” letter to inform physicians and healthcare professionals about the results. If the primary care physician has been working with these urologists, he should have an appreciation of their skills and temperament. However, this does not mean he is referring you necessarily to the best available urologist in your area. His choices may be limited by insurance or hospital networks.

An excellent source of information would be nurses who work in the operating room, recovery room or on the surgical floor where the urologist does his surgery. Asking friends or other individuals who have had experience with the urologist can also prove useful. After a little digging, you can often quickly learn what type of reputation the urologist has in the community. Generally, if an established urologist has a “good reputation” this is an indication that he has pleased many individuals with his care.

Yaz Lawsuit Update 05/17/2012: It has yet to be determined how many more Yaz Lawsuits Bayer will have to face. It is clear that the case is not near an end despite the fact that Bayer is already in settlement talks with a large number of plaintiffs that have already filed a Yaz Lawsuit. The Yaz Lawsuit was filed on behalf of all plaintiffs involved as a single lawsuit although each plaintiff’s damages were set forth individually.

This Yaz Lawsuit was filed based on the following cause(s) of action: strict products liability, breach of express and implied warranty, negligence, negligence per se, fraudulent misrepresentation, fraudulent concealment, fraud, negligent misrepresentation, and unjust enrichment brought by Plaintiffs for damages associated with their ingestion of the pharmaceutical drug YAZ/Yasmin, also known generically as Drospirenone and Ethinyl Estradiol .

Although Bayer has indicated that it plans to start making settlement offers on the 11,000 plus Yaz Lawsuits it currently faces, new Yaz Lawsuits are still being filed.
